Vendor Agreement, Release of Liability and Waiver
In consideration of being permitted to participate as a vendor at events organized by Markham Eid Bazaar (the "Organizer"), I, on behalf of myself and the business I represent (the "Vendor"), agree to the following:
1. Assumption of risk
I understand that setting up, operating and dismantling a booth at a public event involves risks, including but not limited to injury, illness, and loss of or damage to property. I voluntarily assume all such risks.
2. Release of liability
To the fullest extent permitted by law, I release, waive and discharge the Organizer, its organizers, volunteers, sponsors, venue owners and their respective agents (the "Released Parties") from any and all claims, demands and liabilities arising from the Vendor's participation, including claims caused by negligence of the Released Parties.
3. Indemnification
The Vendor agrees to indemnify and hold harmless the Released Parties from any claims, damages, losses or expenses (including legal fees) arising from the Vendor's products, services, staff, booth, or conduct at the event.
4. Property and security
The Organizer is not responsible for loss, theft or damage to the Vendor's merchandise, equipment, cash or personal belongings at any time, including during setup, the event and teardown. The Vendor is responsible for securing their own booth.
5. Vendor responsibilities
- Comply with all venue rules, fire codes and instructions from event staff.
- Hold any licences, permits and insurance required for the products or services offered.
- Food vendors must meet all York Region Public Health requirements, including safe food handling, and hold any required permits.
- Collect and remit any applicable taxes (HST) on sales.
- Sell only lawful, safe goods that are accurately represented, and respect intellectual property and trademark laws.
- Keep the booth area clean and remove all items and garbage at the end of the event.
- Arrive and depart within the setup and teardown times provided by the Organizer.
6. Conduct
The Vendor and their staff will conduct themselves respectfully and in keeping with the family-friendly spirit of the event. The Organizer may remove any vendor who violates these terms, without refund.
7. Fees and cancellation
Booth fees are confirmed by the Organizer in writing. Unless otherwise stated in that confirmation, booth fees are non-refundable. If an event is cancelled by the Organizer, the Organizer's liability is limited to a refund of booth fees paid.
8. Photography and media
I consent to the Organizer photographing or recording the event, including the Vendor's booth, staff and products, and using these images for promotion without compensation.
9. General
This agreement is governed by the laws of the Province of Ontario. If any part is held invalid, the remainder continues in full force. I confirm that I am at least 18 years of age, that I have read and understood this agreement, and that I am authorized to sign on behalf of the Vendor. I agree that my electronic signature is the legal equivalent of my handwritten signature.
